9th January, 2017 P.C.:- In view of the availability of alternative remedy of approaching DRAT as provided under Section 17 of the SARFAESI Act, Petition need not be entertained. If the Petitioner prefers an appeal within a period of four weeks from today, DRAT may consider the aspect of time spent in prosecuting remedy of Writ Petition before this Court while considering the application for condonation of delay that may be presented by the Petitioner. Keeping the option of the Petitioner open to avail of the alternative remedy provided under law, Writ Petition is disposed of.
