Heard Mr. Khajotia, the learned Advocate for the applicant. 2.
My attention is drawn to the order passed by this Court on 4th September 2021 wherein it has been categorically mentioned that the investigating agency in C.R. No.234/2019 filed a report u/s 173 of Cr.P.C. stating therein that the Investigating Officer did not find any substance in the report filed by the complainant in respect of Sale Deed of land bearing Gat No.84/85 admeasuring 0-68-7 H situated in village Varse, Taluka-Roha, District-Raigad. It further revealed that the consideration amount had already been received by the first informant from the accused. Therefore, it was concluded that it was a false F.I.R. which came to be summarized as "B" summary.

Despite direction of this Court, the Investigating Officer is not present today.

Learned APP also is unable to give any reason as to why there is no compliance of the direction issued by this Court. 5.
In that view of the matter, Registry is directed to make report to the Commissioner of Police, Navi Mumbai against PSI Yogesh Pardeshi, NRI Sagari Police Station, Navi Mumbai and to take appropriate action against him. The Commissioner of Police, Navi Mumbai shall submit the Report within 15 days in furtherance thereof, on or before 20th November 2021. 2 / 3

Interim relief granted to the applicant by order dated 18th October 2019 stands confirmed.
