Heard the learned counsel for the petitioner. Advocate for the petitioner submits that they served letter dated 17.10.2016 to the petitioner asking him to remain present before this court for giving instruction. He submits that the said letter was duly served on the petitioner on 18.10.2016. To that effect, he has filed affidavit of service dated 18.10.2016 duly affirmed by Namdeo Indulkar, Special Bailiff of Mumbai. He submits that he does not have any instruction to proceed with the matter.

Hence, Writ Petition stands dismissed for non prosecution.
