IN THE HIGH COURT OF JUDICATURE AT BOMBAY

APPELLATE SIDE - CRIMINAL BAIL APPLICATION NO.2531 OF 2014 Munawar Ali Barkat Ali Shaikh .... Applicant Vs.

The State of Maharashtra .... Respondent Mr. S.D. Butala & Mr. A.A. Sathe for the Applicant.

Ms A.A. Mane, APP, for the RespondentState.

CORAM: P.D. KODE, J.

DATED: JANUARY 16, 2015 P.C:

1.

Heard. Learned counsel for the applicant tenders roznama of the proceedings on record.

2.

By this application the applicant/accused, facing trial for offences under Sections 376(1), 384, 504, 506(II) and 342 r/w Section 34 of the IPC, has prayed for

sjs 15-BA-2531.2014 bail. It is contended that though the trial has commenced, there is no progress after 1-10-2014. A perusal of the roznama does not reveal that the trial has not proceeded solely due to fault on the part of the prosecution.

Having regard to it, it is difficult to accede the prayer for bail. Since the law expects that sessions trial once commenced should be completed as expeditiously as possible, saving just reasons, the Sessions Court is directed to complete the trial at the earliest and in any event before 31-5-2015. The applicant shall cooperate on his part for expeditious disposal of the trial and not to consume time of the Court by making applications of interlocutory nature. The application accordingly stands disposed of. (P.D. KODE, J.)
