By consent of the parties, the impugned order dated 8th October, 2018, passed by the learned District Collector, Pune, in Proceeding No.Grampanchayat Br./Dispute Application/SR/1187/2018, is quashed and set aside and the Appeal, being Appeal No.1187 of 2018, is restored back to its original file.

The learned District Collector, Pune, to decide the application

2/3 filed by the Petitioner, which is at page 54, Exhibit - 'J' to the Petition and thereafter proceed to decide the Appeal, uninfluenced by the order dated 8th October, 2018. The learned District Collector, Pune, to decide the Application and the Appeal, as expeditiously as possible. 3.

Learned Counsel for the Petitioner makes a statement that no further documents will be filed by the Petitioner, before the learned District Collector, Pune. Statement accepted. 4.

Both, the learned counsel for the Petitioner and the Respondent Nos.5, 7 to 20, assure to co-operate with the learned District Collector, Pune, in the expeditious disposal of the Application as well as Appeal and state that they will not seek un-necessary adjournment/s. All contentions of all the parties are kept open. 5.

Both, the Petitioner and the Respondent Nos.5, 7 to 20 to appear before the learned District Collector, Pune, on 16th October, 2018, at 3.00 p.m., after which the learned District Collector, Pune, will give dates convenient to him.

Petition is accordingly disposed of.

It is made clear, that this Petition has not been considered on merits and the learned District Collector, Pune, shall hear the Application as well as the Appeal, on its own merits, in accordance with law, 8.
