Though in this application for condonation of delay, this court, on 3rd July 2015, had ordered for issuance of notice to respondents, as yet, as per report of the Office, affidavit of service on respondent no.1 is not filed by the applicant. Court notice issued to respondent no.1 is also returned unserved. On 18th July 2016 as well as on 16th December 2016, the learned counsel for the applicant had availed time for furnishing fresh and correct address of respondent no.1. None for the applicant.

It appears that the applicant is not serious in prosecuting the application for condonation of delay of 125 days in filing the proceedings challenging the dismissal of his complaint in default.

The application is therefore dismissed for want of prosecution.
