1] The applicant is seeking bail in C.R.No.312 of 2015 registered with Antop Hill Police Station, Mumbai under sections 467, 468, 419, 428 and 511 of Indian Penal Code. 2] Mr. Pradhan learned Counsel appearing for the applicant submits that the one Mr.Harish Patel, co-accused, who is similarly situated like the applicant in the present crime has been released on bail by this Court on 18th November 2015 (B.A.No.2245 of 2015). He further brought to my notice the order dated 18th November 2015
YBG ba2256-15 passed by the trial court, thereby releasing the main accused Altaf Shaikh on bail. Learned APP fairly concedes that the principle of parity applies to the present applicant and he deserves to be released on bail.
3] In view of the above, following order is passed:- (i) the applicant is released on P.R.Bond of Rs.25,000/- with one or two sureties in the like amount.
(ii) The applicant shall attend the I.O. on every Monday between 10.00 a.m. and 12.00 noon till filing of charge sheet; (iii) The applicant shall not tamper with the evidence nor influence the witnesses.
(iv) The applicant is allowed in the above terms.
