By the present Writ Petition, the Petitioner is challenging the legality and validity of the judgment and decree dated 2nd August 2014 passed by the learned District Judge-3, Pune in Civil Appeal No.408 of 2010 by which eviction decree has been passed against Respondent Nos. 1 to 3.

Mr. Sudhir Hardikar, learned counsel appearing for Respondent Nos. 1 to 3 states that parties have settled the dispute and Petitioner has handed over to the Respondents vacant and peaceful possession of the suit property. 1/2

Mr. Ashwin Pimple, learned counsel appearing for the Petitioner states that he has no instructions, as Petitioner is not responding to the telephonic communications. 4.
As Mr. Sudhir Hardikar, learned counsel appearing for Respondent Nos. 1 to 3 states that parties have settled the dispute and handed over the possession of the suit premises to the Respondents, nothing survives in the Writ Petition and it has become infructuous.

However, liberty is granted to the Petitioner to approach this Court, if occasion arises.

The Writ Petition is disposed of in the above terms with no order as to costs.
