The applicant is seeking pre-arrest bail in Crime No.177 of 2015 for the offence punishable under Sections 406, 409, 411, 420 r/w 34 of the Indian Penal Code.

The prosecution has alleged that the applicant is one of the Director of Morya Tech Infra Private Limited. Her husband is also one of the Director, who has practiced fraud on the complainant, which has resulted into registration of the crime in question.

The applicant's husband Avinash is already arrested and prosecution has filed charge-sheet against him.

Upon perusal of the material available on record, it depicts that the main role is attributed to the husband of the applicant, a full time Director of the Company in commission of the crime in question.

There is hardly any material on record to connect the present applicant to the crime in question.

The applicant is a lady, who is very much available for the investigation and there are no criminal antecedents. In view thereof in the event of arrest, the applicant be released on furnishing P. R. Bond of Rs.50,000/- with two sureties in the like amount on the following conditions :

(i) The applicant shall furnish her mobile phone numbers and permanent place of abode to the Investigating Officer within one week from today.

(ii) She shall attend the Investigating Officer on Monday and Thursday for two consecutive weeks and thereafter as and when called for.

(iii) She shall not tamper the evidence or influence the witnesses.
