Learned counsel for the Applicant states that in spite of 90 days being over after his arrest effected on 7.10.2014 no charge-sheet has been filed and as such he wants to approach the Trial Court for the purposes of bail under section 167 (2) of the Code of Criminal Procedure and liberty to re-approach this Court as and when such occasion arises.

In view of the statement made the application stands disposed of as withdrawn with liberty to approach the Special Court for bail under section 167 (2) of the Code of Criminal Procedure. In event of such application being preferred the Special Court shall decide the Megha 1 of 2

8_ba_2536_14.doc same in accordance with law as early as possible. Liberty to the Applicant to re-approach this Court in accordance with law. It is expressly recorded that motion for withdrawal was made without advancing any submission on merit.
