Heard the learned counsel for the parties.

By this petition, under Article 227 of the Constitution of India, petitioner org.defendant no.1 challenges the order dated 28.9.2010 passed by 7th Joint Civil Judge, Senior Division, Pune below Exhibit-88 seeking condonation of delay in filing counter claim. The present Writ Petition stand dismissed against respondent nos.1 and 2 org.plaintiff. Thereafter, plaintiff preferred Civil Application No.137 of 2014 for restoration. That Civil Application stand dismissed by order dated Mohite 1/2

Considering the subsequent development, I do not find anything survives in the present Writ Petition.

Hence, Writ Petition stands rejected as infructuous.
