Learned counsel for the petitioner seeks leave to withdraw the petition with liberty to approach the magistrate having jurisdiction for change of date of birth in the passport. Leave with liberty as prayed for, is granted. The writ petition stands dismissed as withdrawn. 2.

In the event, the petitioner makes such application within four weeks from today, the concerned magistrate shall dispose of the same expeditiously. It is expressly made clear that we have not gone into the merits of the matter and such application shall be decided in accordance with law.
