The Asstt. Commissioner of Labour issued a Recovery Certificate under Section 33-C-(1) of the Industrial Disputes Act, 1947 after the Award was passed by the Presiding Officer, Fourth Labour Court, Thane in Ref(IDA) No.100 of 2008. A demand notice was also issued. A copy of the same is annexed herewith.

It is submitted that the Respondent-Authority is executing and implementing the Award and notices. It is submitted that the representation was made on 12th August 2013 addressed to the Collector (Exhibit-I to the petition).

wp.12129-2013 The learned Counsel appearing for the Petitioner submits that the Respondent Nos.4 and 5 have been served by private notice. Without expressing any opinion on the merits of the claim of the Petitioner, we direct the Collector, Thane to look into the grievance of the Petitioner and issue necessary instructions within a period of 4 weeks. Writ Petition is disposed of.
