The Petition can be disposed of in view of the consensus that has been arrived between the parties that the Criminal Appeal No. 167/2017 itself be decided by the Sessions Court in a time bound manner. 2.

Considering that the Appeal has been preferred in the year 2017 against an order of maintenance, it is in the interest of justice that the Sessions Court be requested to hear the Appeal in a time bound manner as suggested by the learned counsel for the parties. 3.

In light of the above, the impugned order dated 29th September,

WP-501-3746-2023.doc 2023 issuing distress warrant is quashed and set aside. 4.

This Court is informed that the matter is listed before the Sessions Court on 20th January, 2024. The date of hearing is pre poned to 21st December, 2023. The Court of Sessions of Dindoshi is requested to hear the Criminal Appeal No. 167 of 2017 expeditiously and decide the same on or before 20st January, 2024. Learned counsel for the parties submit that they will appear before the Sessions Court on 21st December, 2023 and proceed with the hearing.
