It is alleged the applicant deterred public servant from discharging his duty when the Municipal Corporation Squad went to demolish the unauthorised construction. The other two accused are released on bail by this Court. The punishment for the subject offence is two two year, with a fine or both. In view of the facts of the case and the nature of accusations, the following order is

ORDER

(i) The Anticipatory Bail Application is allowed. (ii) In the event of the arrest of the applicant arrested in C.R. No. 97 of 2019 registered with Uttari Sagari Police Station for the offences punishable under Sections 353, 143, 147, 149 and 506 of the Indian Penal Code and under Sections 37(1) and 135 of the Maharashtra Police Act on furnishing P.R. Bond of Rs.20,000/- (Rs. Twenty Thousand only) with one or two sureties in the like amount.

(iii) He shall file Undertaking in this Court that he shall not indulge into similar activities or acts.

(iv) It is made clear that if the applicant indulges into similar activities, the respondentState shall move an application for cancellation of this order.

3/3 ABA-2329-2019 (SR.36) (v) Since the investigation is in progress, the applicant shall attend the Police Station concerned as and when called om Monday, first week of December, 2019 between 11 to 1.00 p.m. and thereafter as and when called.

(iv) The applicant shall furnish the particulars of his latest place residence and mobile contact number and/or change of residence or mobile details, if any, to the Investigating Officer of the Police Station concerned within seven days from today;

(v) The applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

The Anticipatory Bail Application stands disposed off in above terms.
