..Petitioners.

Versus

State of Maharashtra & Another.

..Respondents.

Mr. D. D. Shroff i/b Thakordas & Madgavkar for the Petitioners. Mr. K. V. Saste, learned APP for the State.

Coram : RANJIT MORE & SMT. ANUJA PRABHUDESSAI, JJ.

Date : April 22, 2015.

P. C. :

1.

Heard. The petition is filed, seeking to quash the proceedings of Special Case No.25 of 2009 pending on the file of Special Judge (CBI) at Greater Mumbai. The FIR is of the year 2005. The charge-sheet is filed in the year 2009. Thereafter the Petitioners have approached this Court by filing the present writ petition in the year 2014. After the lapse of such a long period, we do not see any reason to accede to the request. 2.

At any rate, we are of the view that the Petitioners have an alternate efficacious remedy of seeking discharge before the trial Court itself. We are, therefore, not inclined to entertain patilsr 1 / 2

this writ petition and exercise extra-ordinary jurisdiction of this Court. Consequently, writ petition is dismissed. 3.

The learned trial Court will endeavour to dispose of the Petitioners' application for discharge within six months of its filing.
