IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION WRIT PETITION NO.3958 OF 2016 Rajesh Sakaldeo Yadav

...Petitioner

vs.

The State of Maharashtra and Ors.

...Respondents

---- None for the Petitioner.

Smt. Aruna S. Pai, APP for the Respondent/State. ---- CORAM : B. P. DHARMADHIKARI & N. R. BORKAR, JJ.

DATE : 2/1/2020.

P.C.:

.

Nobody for the petitioner. Learned APP has pointed out that the matter was first placed before this Court on 2/11/2017 and on said date also nobody appeared for the petitioner. 2.

According to learned APP grievance is of civil nature. 3.

It appears that the petitioner has approached this Court earlier in Writ Petition No.2450/2016 which was disposed of on 8/8/2016 with directions to police authorities to take appropriate decision on complaint filed by him and to communicate it to him.

4.

Grievance made in complaint dated 3/8/2016 is that those persons mentioned therein as partners have suddenly withdrawn from partnership and demanded money back together with interest. This exposed the petitioner to demands by his customers.

rsk 2/2 28-WP-3958-16.doc 5.

Petitioner has not bothered to move the petition till October 2016. After 2/11/2017, the matter has remained pending without any effective orders for more than 3 years.

6.

Therefore without observing anything on merits of the controversy and keeping all contentions of the petitioner open as also with liberty to the petitioner to take such other steps as are open in law in the matter, we dispose of the writ petition.
