Heard learned counsel for the parties on both Civil Applications. 2.

We have gone through the Civil Application No. 2707 of 2017 seeking condonation of delay in filing Civil Application (St) No. 30521 of 2017. For the reasons stated in the Civil Application seeking condonation of delay, we find that the delay has been satisfactorily explained. Accordingly we condone the delay and allow the Civil Application.

We have also gone through the Civil Application (St) No.30521 of 2017 seeking restoration of the Writ Petition No.4602 of 2016 which suffered dismissal vide order dated 4.4.2017 for want of prosecution. For the reasons stated therein, we are of the view that there was sufficient cause for non appearance of the counsel when the case was called out. In the circumstances, we allow Civil Application and restore the Writ Petition No. 4602 of 2016 to its original number.
