Out of the matrimonial discord and in view of the complaint filed by the complainant-wife Crime No.355 of 2016 came to be registered against the applicant for the offence punishable under Sections 498(A), I 377, 406, 313, 504, 506 of the Indian Penal Code.

The narration in the F.I.R. depicts all these tale instances. It is claimed in the F.I.R. that the cash of Rs.2,00,000/- and the jewelery ornaments of Rs.77,000/- were taken away by the present applicant.

Mr. Chandan, the learned Counsel for the applicant upon instructions makes a solemn statement that the applicant shall deposit an amount of Rs.3,00,000/- with the Investigating Officer in response to the above referred allegations. The said statement is accepted in the form of undertaking. The applicant shall deposit the said amount with the Investigating Officer within a period of two week from today.

In the above referred background, in my opinion, the custodial interrogation of the applicant is not called for. Hence, in the event of arrest, the applicant be released on furnishing P. R. Bond of Rs.50,000/- with two sureties in the like amount on the following conditions :
(i) The applicant shall furnish his mobile phone numbers and permanent place of abode to the Investigating Officer within one week from today.
(ii) He shall attend the Investigating Officer on Monday and Thursday for two consecutive weeks and thereafter as and when called for.
(iii) He shall not tamper the evidence or influence the witnesses.
