By this Civil Application the original Petitioner seeks modification of an order of 5th October 2017 (MS Sonak J) to a limited extent. The order of 5th October 2017 required the Petitioner to deposit the entire decretal amount in this Court. It was modified on 13th October 2017, then permitting the Petitioner to deposit the entire amount in the Trial Court. The application now is for a modification that instead of a cash deposit, the original Petitioner be allowed to furnish a bank guarantee to the satisfaction of the Trial Court and to 7th November 2017

904-CAC386-17.DOC furnish an undertaking to the satisfaction of that Court. There can be no objection to this. The Petitioner is the Central Bank of India and a bank guarantee will be undoubtedly sufficient. The undertaking will be furnished by an authorised officer of the Central Bank of India. 3.

The Civil Application made absolute in terms of prayer clause 15(a) and is disposed of.
