Considering the nature of accusations faced in the subject CR, the Investigating Officer had issued a notice under section 41-A of Cr.P.C to the applicants on 26/4/2022. The learned APP state that the applicants have failed to abide by the said notice instead choose to approach the sessions court which rejected their application filed under section 438 on 21/10/2022.

Let the applicants report to the Investigating Officer within a period of seven days from today.

Upon their attendance, the Investigating Officer shall follow procedure prescribed under Section 41A of the Cr.P.C., and record reasons in writing in case he is desirous of effecting arrest of the Applicants.

The Investigating Officer shall also give advance notice of Ashish Mhaske
