In Crime No. 555 of 2017 for an offence punishable under Sections 403, 417, 420 of the Indian Penal Code and Sections 3 and 4 of the Maharashtra Protection of Interests of Depositors (in Financial Establishment) Act, 1999, the Applicant is seeking regular bail. 2.

Attention of this Court is also invited to the order dated 25th January 2019 passed in Writ Petition (Criminal) No.17 of 2019 wherein the Apex Court has ordered no coercive action against the Company and the parties who were before it.

In the circumstances of the allegations made in the First Information Report, Applicant volunteers to deposit an amount of Rs.8,00,000/- with the Investigating Officer within a period of three weeks from today. Since the statement is made on instructions, same is accepted as an undertaking.

In view of above, a case for grant of 1bail is made out. Hence, the following order.

ORDER

(A) The Applicant be released on bail in Crime No. 555 of 2017 for an offence punishable under Sections 403, 417, 420 of the Indian Penal Code and Sections 3 and 4 of the Maharashtra Protection of Interests of Depositors (in Financial Establishment) Act, 1999 on executing PR Bond of Rs.25,000/- with one or more sureties in the like amount.

(B) The Applicant shall neither tamper the evidence of prosecution nor influence the prosecution witnesses.

It is made clear that in case if the Writ Petition in which Pursuant to the order dt/-4.2.2019 original order is corrected.

3/3 Yadav 918-B.ba.2689.18 (corrected) registration of the present crime is under challenge is dismissed by the Apex Court or the order passed therein in any way favours the interest of the prosecution, it shall be open for the prosecution to move for cancellation of bail.

With the above observations, Bail Application stands disposed of.
