Heard the learned Counsel for the Applicant and learned Special Public prosecutor for NIA.

Learned Special Public Prosecutor submits that the NIA is taken over the investigation and bail application was not filed by the Applicant before NIA Court.

Learned Counsel for the Applicant submits that direction be given to the NIA Court to decide the bail application filed by the Applicant on its own merit and without influenced by earlier order. Learned Counsel for the Applicant further submits that he would D.A.Ethape, P.A. 1

I have heard both the learned Counsels.

Considering the submission of learned Counsel for the Applicant, application is allowed to be withdrawn with liberty to file fresh bail application before the NIA Court.

N.I.A. Court shall decide the bail application, if filed by the Applicant on its own merit and without influenced by earlier order. 7.
