1. Rule. Rule made returnable forthwith by consent of parties.

2. By consent of the parties, an order dated 03.09.15 passed by Learned C.J.J.D, Pune in Regular Civil Suit no. 2730 of 2012, while recording further examination-in-chief of the plaintiff/ petitioner, is set aside.

3. The document namely agreement to sale dated 02.05.85 produced with the list Exhibit 59/9 is ordered to be taken on record and marked as Exhibit. The further trial to go on.

4. Marking the document at Exhibit 59/9 as aforesaid will not amount to either the proof of its contents or the legality thereof. All contentions in that regard are kept open. Basavraj G. Patil 1/2
