Learned counsel for applicant submits that the applicant has been convicted and his application for suspension of sentence was rejected by Appellate Court. He further submitted that on the basis of High Power Committee guidelines, the applicant has been released and presently he is out of custody.

In view of the aforesaid submissions, present application is allowed to be withdrawn with liberty to prefer fresh application for suspension of sentence as and when the applicant surrenders to custody. The bail application stands disposed of. (PRAKASH D. NAIK, J.) MST
