Heard learned counsel for the applicant and learned APP.

This is an application for pre-arrest bail in respect of First Information Report No.608 of 2022 dated 01/10/2022 registered with Sahar Police Station, Andheri, for the offence punishable under Sections 465, 468, 471, 420 read with Section 34 of the Indian Penal Code, 1860 (hereafter "the IPC", for short).

Learned APP submitted that the applicant was served with a notice under Section 41A of the Code of Criminal

14. ABA 3194-2022.doc Procedure (hereafter "the Cr.P.C.", for short). Though he was asked to report to the Investigating Officer, he preferred to approach the Sessions Court for anticipatory bail. The Sessions Court rejected the application. Learned counsel for the applicant submits that apprehending arrest, the application was filed before the Sessions Court. Learned counsel for the applicant further submitted that the applicant is willing to co-operate with the investigation and will appear before the Investigating Officer in compliance with Section 41A notice.

In view of the stand taken, the applicant shall report to the Investigating Officer on 28th, 29th and 30th November, 2022 between 11.00 a.m. and 1.00 p.m. and thereafter, as and when called. In case the Investigating Officer wants to effect the arrest in the wake of the reasons recorded by him he shall give 72 hours notice in advance to the applicant. 5.
