Perused the impugned order. The impugned order was passed in the absence of the applicants (accused Nos. 1 and 2) and respondent No. 2 complainant. It is admitted position that neither the applicants and their lawyer nor the 1/2
18)APL1177.14 respondent No. 2 and his lawyer were present when the order in question was passed. It is also admitted position that nobody was heard before passing order below Exhibits 91 and 92 in Criminal Case No. 2856/2012. Such an order cannot be sustained and needs to be set aside.
The impugned order passed below Exhibits 91 and 92 in Criminal Case No. 2856/2012 is set aside. The learned trial Magistrate is directed to hear the applicants and respondent No. 2 before passing any order below Exhibits 91 and 92 in Criminal Case No. 2856/12.
The application stands disposed of.
