Heard the learned counsel for the applicant and the learned counsel for the respondent. The challenge in the Family Court Appeal is to the Decree of restitution of conjugal rights passed by the learned Judge of the Family Court on a counter claim filed by the respondent. As the appeal has been already admitted for final hearing, the said Decree cannot be allowed to be executed.

Accordingly, we pass the following order:

We direct that there will be stay to the execution and operation of clauses 2 and 3 of the operative part of the impugned Decree dated 16th July 2012.
