This is an application for Anticipatory bail filed by the aforesaid Applicant apprehending his arrest in C.R No.157 /2015 under section 420, 467, 468, 471 r.w. section 34 of the Indian Penal Code.

Heard the learned counsel for the Applicant and learned APP for the State. The record prima facie reveals that the daughter of the Applicant herein had lodged the FIR dated 29th October 2015 alleging that the Applicant herein who was the joint holder of one

Investment Bond namely Sardar Sarovar Narmada Nigam Limited had forged her signature and encashed the amount of ` 17,89,715/-.

The record prima facie reveals that the relations between the Applicant and his daughter are strained as the daughter of the Complainant had married against the wishes of the Applicant. There is dispute between them over immovable properties including transfer of a flat to another daughter. The nature of the allegations made against him in my considered view do not warrant custodial interrogation. The Applicant is 77 years of age and has roots in the society and there are no chances of the Applicant absconding or thwarting the course of justice. Considering all the above factors, the Application is allowed on the following termsi) In the event of arrest of the Applicant in C.R. No.157 / 2015 the Applicant shall be released on bail on furnishing bail bond of `20,000 /-(Rupees Twenty Thousand only) with one solvent surety of the like amount to the satisfaction of Judicial Magistrate F.C.- Pune.

ii) The Applicant shall report to the Investigating officer for a period of seven days from 10.00 a.m to 1.00 p.m. or as and when required by the Investigating Officer for the purpose of interrogation/investigation.

iii) The Applicant shall not leave the country without prior permission of the learned Judicial Magistrate, Pune till filing of the charge-sheet.
