This Application is moved for restoration of Criminal Application No. 367 of 2018, which was dismissed on 6th October, 2018 for non-prosecution. Criminal Application No. 367 of 2018 was filed for restoration of Writ Petition, which was dismissed by this Court on 10th September, 2018.

The learned counsel for the applicant submitted that she could not attend the matter on 10th September, as she was in

505.APPW407_2018.doc Calcutta High Court for arbitration matter at the relevant time, so the Writ Petition was dismissed for non-prosecution. She further submitted that thereafter she moved an Application for restoration of Writ Petition, which was also dismissed on 6th October, 2018, as she was out of station and, therefore, it was not possible for her to attend the matter. She prays that the orders dated 10th September, 2018 and 6th October, 2018 be recalled and the Writ Petition be restored.

In view of the submissions, the orders dated 10th September, 2018 and 6th October, 2018 are hereby recalled. Writ Petition along with the interim order, if any granted earlier, is restored to its original file.

Criminal Applications are allowed and are disposed of accordingly.
