Heard learned Counsel for the parties.

It is submitted that petitioner was elected as a member of Gram Panchayat. The petition for disqualification was filed by respondent no.5 on the ground that 3rd child was born to the petitioner after the prescribed cut off date under the provisions of The Maharashtra Village Panchayats Act, 1958. By an order dated 24th April, 2015 the Additional Collector, Solapur allowed the said petition No.85/2013 and declared the petitioner

2/2 7wp13236.16.sxw as disqualified and unseated him. It is submitted that against the said order appeal was preferred by the petitioner to the Divisional Commissioner, Pune. The said appeal is pending consideration since last one year.

We direct the Dy. Commissioner, Pune who is entrusted with the hearing of such appeals to finally dispose of the appeal within eight weeks from the date of receipt of this order. 4.

With aforesaid directions, Writ petition is disposed of. 5.
