It appears from the order dated 24th August, 2018, that this Appeal was heard and thereafter the appellant was called upon to argue on the point of maintainability of the Appeal in absence of plaintiff no.1 who died during the pendency of the First Appeal and his

None appears for the appellant. Learned Counsel Mr. Deo, appears for the respondents. Hence, the matter is dismissed for non-prosecution.

In view of dismissal of Appeal, Civil Application No. 1594 of 2014 taken out for stay does not survive. The same is accordingly disposed of.
