By this Civil Application, Applicant is seeking condonation of 144 days delay in filing First Appeal challenging the judgment and award dated 13.3.2014 passed by Employees Insurance Court, Kolhapur in Application (ESI) No.1 of 1994.

The learned counsel for the Respondent vehemently opposed the present Civil Mohite 1/2

8 caf2871-15.doc Application. He submits that Applicant has not shown sufficient cause for condonation of delay. Therefore, Application is required to be dismissed with cost.

Considering the submissions made by the learned counsel for the Applicant and the averments made in Civil Application, I am satisfied that the Applicant has made out a case for allowing the Civil Application. Hence, following order is passed:

Delay in filing Civil Application is condoned.

b.

Civil Application stands disposed of accordingly.

No order as to costs.
