This is the second application for bail. The earlier application for bail preferred by the applicant was dismissed by this Court by an Order dated 28.9.2016.

The record indicates that, the earlier application for bail preferred by the principal accused namely Sohail Khan bearing No.1017/2016 was rejected by the co-ordinate Bench (Shri. P.D.Naik, J.) by its Order dated 15.7.2016. That, by an Order dated 26.7.2018 the said co-accused Sohail Khan has been directed to be released on bail by the same Co-ordinate Bench. The record indicates that, the applicant was employed as a driver of the said principal accused Sohail Khan and has played little lessor role in the crime than Sohail Khan.

2 /2 5-aba-2703-18.doc As the principal accused Sohail Khan has been directed to be released on bail, the applicant is entitled to be released on bail on the ground of parity.

Hence, the following order.

a) The applicant is directed to be released on bail by executing PR bond in the sum of Rs.20,000/- with one or more sureties in the like amount in connection with Sessions Case No.95 of 2016 pending in the Court of Sessions Court at Dindoshi, Mumbai.

b) The applicant is permitted to furnish cash security in the sum of Rs.20,000/- in lieu of the sureties for a period of four weeks from the date of release.

c) The applicant is directed to attend Bangur Nagar Police Station, Mumbai once in a month on every first Saturday of the month between 10.00 a.m. and 12.00 noon till the disposal of the trial.

d) The applicant shall not tamper with the evidence and/or influence the prosecution witnesses.
