1] The present application is filed by Ms. Ila Khristi on the footing that, she being legal guardian of the minor victim girl appointed by the Child Welfare Committee.

2] In Order dated 12th January 2017 passed by this Court, the learned Counsel for the applicant had made a statement that the victim girl has now attained majority and intending to take necessary steps for prosecuting the present application.

3] Indubitably the present application is not filed by the victim girl. The applicant does not have locus-standi for filing application for leave to 1/2

appln.167-2018.doc file appeal against the Order of acquittal.

4] Facing with the said difficulty, the learned Counsel for the applicant seeks leave to withdraw the present application with liberty to file a fresh application for leave to file appeal on behalf by the victim girl. Leave and liberty granted.
