The grievance of Petitioner is of two fold i.e. (i) he may be provided with an Advocate at the cost of Government i.e. Legal Aid and (ii) to expedite his case.

As far as providing of Legal Aid is concerned, Learned APP on instructions from Mr. Babar, PSI, Santacruz Police Station, Mumbai submitted that, Petitioner is Accused No.2 in the said crime and he is being represented by Advocate Mr. Abdul Wahab Khan. A photocopy of Rozama dated 23rd November, 2022 is produced on record in that behalf. 1/2

In view thereof, the grievance of Petitioner that, he be provided with Legal Aid at the cost of Government, according to us does not survive. However we hereby permit Petitioner to file an Application before the Trial Court, if he desires to have Legal Aid at the cost of Government before the Trial Court, which will be considered by learned Judge of the Trial Court as per the provisions of law. 4.
As far as second grievance that, the trial of Petitioner is being delayed is concerned, learned APP on instructions further submitted that, the Trial Court has now issued witness summons in the said case and the next date for recording evidence is now scheduled on 24th November, 2022.

In view thereof, nothing further survives in the Petition and is accordingly disposed off.

In view of disposal of Petition, Interim Application Nos.3760 of 2022, 3758 of 2022 and 3762 of 2022 do not survive and are accordingly disposed off.
