Learned APP at the outset submits a report that the applicant is being prosecuted in R.C.C. No. 154/16 arising out of Crime No. 121 of 2016 registered at Kavathe Mahakal Police Station. That in R.C.C. No. 154/16 the prosecution has recorded substantive evidence of almost all the witnesses and it would not be appropriate to consider the application under section 439 of the Code of criminal Procedure, 1973 at this stage. Hence, the learned Magistrate is requested to make endeavour to conclude the trial as early as possible. The application stands dismissed and disposed of accordingly. (SMT. SADHANA S.
