Heard. This Application is for condonation of 283 days delay in preferring the appeal challenging the judgment and award dated 26/10/2016 passed by the MACT Thane in MACP No.357/2012 for additional compensation.

Though the Respondents are duly served, none appeared for Respondents when the matter was called out for hearing.

70.1214.18-caf.odt Application, I am satisfied that the Applicant has made out a case for allowing the Civil Application.

Hence, following order is passed:

a.

Delay in filing the First Appeal is condoned.

b.

The Civil Application stands disposed of accordingly.

c.

No order as to costs.

d.

The Appellant / Applicant is directed to remove all office objections on or before 31.08.2019, failing which the First Appeal shall stand dismissed without further reference to the court.

e.

If all Office objections are removed within stipulated time as stated hereinabove, Office is directed to place the First Appeal on board on 16.09.2019, for admission.
