1] Heard respective counsel. In response to the Court's query, learned counsel for the non applicant submits that he is willing to bear conveyance charges to the tune of Rs. 10,000/- towards travelling from Pune to Aurangabad and back to Pune including lodging and boarding facility.

2] Said proposal is not accepted by the Applicant. 1/2

17.11.2020 mca.doc 3] In the aforesaid background having heard respective counsel, I am of the view that present Application needs to be allowed in terms of prayer clause (A), as the Applicant is custodian of minor ailing daughter and as such Applicant will suffer more hardship. Apart from above, fact remains that proceedings initiated under Protection of Women from Domestic Violence Act, 2005 are already attended by the non-applicant in Pune Court.

4] However, in the interest of justice, it is directed that both these proceedings be posted on the very same day so as to avoid inconvenience to the parties.

5] Application is allowed in the above terms.
