This is an application fled under Section 438 of the Code of Criminal Procedure, 1973 for grant of anticipatory bail. 2.

The applicants are apprehending their arrest in C.R. No.0780 of 2022 registered at Mangalwedha Police Station, Dist. Solapur for the ofence punishable under Sections 114,332, 353, 504 and 506 of Indian Penal Code.

The complainant is Surpanch of village- Chokhamola Nagar. On 13 October 2022 Gramsabha was organized. According to the prosecution while the Gramsabha was going on the present applicants assaulted and threatened the complainant as according to the applicants, the complainant was not doing any developmental work in their ward.

I have heard the learned Counsel for the applicants and the learned APP for the State.

The learned counsel for the applicants submits that the complainant has lodged the false report due to political rivalry. It is submitted that nothing is to be recovered from the applicants and therefore, their custodial interrogation is not necessary. It is submitted that there are no other criminal antecedents. It is accordingly submitted that applicants be released on anticipatory bail.

On the other hand learned APP submits that considering the nature of ofence the applicants may not be released on anticipatory bail.

I have perused the FIR. The common and general allegations are made against all the accused. Nothing is to be recovered from the applicants and therefore their custodial interrogation is not necessary. There are no other criminal antecedents. I am therefore inclined to grant anticipatory bail to the present applicants. Hence, the following order:

ORDER

(i) Application is allowed.

(ii) In the event of arrest of applicants in connection with C.R. No.0780 of 2022 registered at Mangalwedha Police Station, Dist. Solapur for the ofence punishable under Sections 114, 332, 353, 504 and 506 of the IPC, they shall be released on bail on furnishing P.R. Bond in the sum of 2/3

3/3 Rs.15,000/- each with one surety in the like amount. (iii) The applicants shall attend the concerned police station from 23 November 2022 to 25 November 2022 between 11.00 a.m. to 02.00 p.m. and thereafter as and when called by Investigating Ofcer and shall co-operate in the investigation.
