The learned counsel for the Applicant, on instructions, seeks leave to withdraw this Application. 3.

Considering his request, Application is allowed to be withdrawn and disposed of.

The learned counsel for the Applicant submitted that, Applicant is 19 years old. He is behind bar almost three years and N.S. Kamble page 1 of 2

909-ba-3498-2022.doc co-accused are not attending dates regularly hence trial has delayed. Hence, direction be given to Trial Court to separate his trial and expedite it.

Considering the submission of the learned counsel for the Applicant, trial Court is requested, after filing of the Application for separation of trial by the Applicant it be decided on merit.

It is noticed by this Court that in many cases, accused have been released on Covid bail but they have not surrendered though Covid is over. The Secretary, MALSA, shall take information regarding how many prisoners, who have been granted Covid bail, have not surrendered and what steps have been taken by the concerned authority against them though they have not surrendered, and give report to this Court, within three weeks.
