After hearing the Learned counsel for the applicant, when this court was not inclined to grant any relief, the Learned counsel for the applicant on instructions from the relatives of the applicant who are present in court seeks leave to withdraw the present application with liberty to file a fresh bail application if the trial pertaining to Special Case No.18/2000 is not concluded within a period of 4 months from today. Leave and liberty is granted.

2 /2 BA-2273-15 2) The record discloses that the trial pertaining to Special Case No.18/2000 was concluded and the other two accused persons have been acquitted by the Special Court by its judgment and order dated 29.6.2010. It further appears that the trial pertaining to the applicant was separated on 22.3.2006 as the applicant was not available for trial. Learned counsel for the applicant submitted that as far as the applicant is concerned only his statement under Section-313 of the Cr.P.C., his argument and judgment is to be passed qua the applicant. In view of the above, the trial court is hereby directed to expedite the trial qua the applicant in CBI Special Case NO.18/2000 and conclude the same preferably within a period of 3 months from the date of receipt of the present order. Application is dismissed with the aforesaid liberty granted to the applicant.
