Heard learned counsel for the applicant.

The pre-arrest bail is sought by the applicant in respect of an offence registered with Dharavi Police Station under sections 420, 34 of Indian Penal Code vide F.I.R. No. 1198 of 2022.

Learned APP submitted that notice under section 41A of the Code of Criminal Procedure, 1973 ('CrPC", for short) was given to the applicant, but the applicant has not

26 aba 3195.22.doc responded. Learned counsel for the applicant submits on instructions that the applicant is willing to co-operate with the investigation and will appear before the Investigating Officer in response to notice issued under section 41A of CrPC.

The applicant to report to the Investigating Officer in compliance with the notice issued under section 41A of CrPC on 26/11/2022, 27/11/2022 and 28/11/2022 between 11.00 a.m. and 1.00 p.m. and thereafter as and when called. In case if the Investigating Officer wants to effect the arrest in the wake of the reasons recorded by him, he shall give 72 hours notice in advance to the applicant. 5.

The application is disposed of.

The interim application also stands disposed of.
