Heard the learned counsel for the parties.

By this petition under Article 227 of the Constitution of India the Petitioner challenges the order dated 19.8.2013 passed by Competent Authority in deemed conveyance application no.180 of 2013.

The learned counsel for the respondent no.2 Society submits that as per impugned order dated 19.8.2013 the owner of the suit property i.e. respondent no.4 already executed deed of assignment of lease in their favour by registered document dated 10.10.2015. He further submits that even the original owner filed Writ Petition Mohite 1/2

14 wp2951-17 No.6130 of 2016 challenging the same deed conveyance order dated 19.8.2013. Same was withdrawn by them unconditionally. He submits that in view of these facts, nothing survives in the present Writ Petition.

Considering the subsequent development in the present matter and as owner already executed the document in favour of respondent no.2, Society and same was registered on 10.10.2015, Writ Petition stands rejected. No order as to costs. (K.K.TATED, J.) Mohite 2/2
