The above writ petition is filed for quashing the FIR bearing C.R.No.35 of 2012 registered with Shirol Police Station, Kolhapur for the Shivgan 1/3

offence punishable under Section 409 of the Indian Penal Code, 1860. By the order dated 28.1.2013, this Court granted Rule and by way of ad-interim relief, respondent was directed not to file charge-sheet against the petitioner.

The above criminal application is filed by the State for modification of the order dated 28.1.2013.

Mr. Killedar, learned counsel for the petitioner, tenders a copy of the letter dated 18.12.2014 written by the Sub Divisional Police Inspector, Jaisingpur Division, Jaisingpur. Letter discloses that after completion of investigation, Shirol police station has filed 'C' Summary Report. Letter is taken on record and marked Ex.'X' for Identification. Ms. Deshmukh, learned APP for the State having taken instructions from Mr. Lokare, Head Constable attached to Shirol Police station, does not dispute the same.

In the light of facts and circumstances stated above, nothing survives in the petition as well as in the application for consideration and the same are, accordingly, disposed of.
