Rajendra Kalicharan Verma v. V. S. Thorath-Bhasale And ORS
CONP. 5-15 VPH
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CRIMINAL APPELLATE JURISDICTION CONTEMPT PETITION No. 5 OF 2015 Rajendra Kalicharan Verma ...
Petitioner Vs.
V. S. Thorath-Bhasale & Ors.
...
Respondents *** Mr. Rajendra Verma, the Petitioner in person. Dr. F. R. Shaikh, APP for Respondent - State. *** CORAM : V. M. KANADE, & REVATI MOHITE DERE, JJ.
DATE : NOVEMBER 30, 2015 PC.
1.
The grievance of the Petitioner is that though he had filed a petition for quashing of the criminal complaint, Respondents were pleased to file the charge-sheet against him. It is submitted that since writ petition for quashing was pending in this Court, charge-sheet could not have been filed against him.
2.
It is an admitted position that no interim order was granted by this court in the said petition, which was filed for quashing of the criminal complaint. Hence, in our view, it cannot be said that Respondents have committed contempt. Reserving the right of the Petitioner to adopt an appropriate remedy, which is available to him in law, criminal contempt petition is disposed of. Sd/- Sd/- [REVATI MOHITE DERE, J.] [V. M.
