This is an application for temporary bail on the ground of advanced stage of pregnancy of the wife of Applicant. 2.

Learned counsel appearing for Applicant submitted that, there is nobody in the family of Applicant to look after the wife of Applicant who is in advanced stage of pregnancy. That the Applicant was released on Covid-19 Pandemic parole leave and has surrendered to jail Authority within stipulated period. That, there is no report of breach of any conditions imposed upon him. 3.

Learned APP, on instructions, submitted that wife of Applicant MANISH SURESH THATTE by MANISH SURESH THATTE Date: 2022.12.27 15:14:04 +0530 is residing in the house of father of Applicant. That, the father of Applicant is an aged person and also suffering from various ailments.

It is not disputed that, apart from the father of Applicant, there is nobody to look after the wife of Applicant. The medical documents of wife of Applicant namely Mrs.Vaibhavi Pramod Shinde are annexed to the application.

In view of the above, we are inclined to release the Applicant on temporary bail from 1st January 2023 till 15th February 2023 on the following terms and conditions :

(i) Applicant is directed to be released on temporary bail for the period from 1st January 2023 till 15th February 2023, on his executing P.R bond in the sum of Rs.25,000/- with one or two local sureties in the like amount, with the Superintendent of Kolhapur Central Prison, along with documents of his residence where he, his wife and his father are residing;

(ii) Applicant shall report to Jail Authority of Kolhapur Central Prison, Kalamba on or before 12.00 noon of 16th February 2023 without any excuse.
