Learned counsel for the applicant upon instructions seeks liberty to withdraw the application with further liberty before the court of concerned Magistrate and file an application under Section 437 of Cr.P.C. Liberty as prayed for is granted in the interest of justice. The applicant shall not be arrested till 5.00 p.m. of 14th June 2018. In the eventuality, the applicant appears before the Magistrate, the Magistrate shall consider the application on its own merits and preferably dispose of the same on the same day without being influenced by the withdrawal of the application under Section 438 of Cr.P.C.
