Heard learned Counsel for the parties.

By consent, the impugned order passed by the Member of the Industrial Court, Maharashtra, Mumbai on 12 October 2011 on the recovery application of Respondent No.1, namely, Recovery Application (ULP) No.10/2001 is set aside. The recovery application is served on the Petitioner. Mr.Nerlekar, Counsel appearing for the Petitioner, accepts service of the recovery application. The recovery application shall be considered afresh after giving an opportunity to the opponents therein to show cause, in accordance with law. The recovery application shall be disposed of by the Industrial Court, as expeditiously as possible and in any event, within six months from today. Since the impugned order directing issuance of a certificate is already set aside, the recovery certificate issued in pursuance of the order is also set aside. All rights and contentions of the parties on merits are kept open. The petition is disposed of, accordingly.
