Heard the learned counsel for the applicant and Mr.Agarkar, learned APP for the State.

The applicant is apprehending the arrest in Crime No. I 250/2019 registered under Sections 354, 504, 506 of the Indian Penal Code with the Vartak Nagar Police Station, Thane. 1/4

Perused the complaint dated 21.09.2019.

The victim lodged the complaint that the applicant sent text message and called her for interview at a Viviana Mall at Thane. She responded to it and went to Viviana Mall at 2 O' clock. Thereafter, the victim and the applicant had gone to see the movie. It is alleged that since the applicant did not discuss about the job offer and divulge particulars, she was about to leave the theatre. However, it is alleged, applicant restrained her movements and in the course of it, outraged her modesty. On this expression, the crime aforesaid was registered.

It is submitted across the bar that the applicant is a Civil Engineer and has a permanent residence as disclosed in the cause title. The Learned APP seek custody of the accused to find out the source from he secured mobile number of the victim. 2/4

The Learned APP has pointed out that another offence that has been registered against the applicant vide Crime No. I- 153 of 2019 with Vartak Nagar Police Station under Sections 347, 365, 388, 323, 504, 506 read with 34 of Indian Penal Code. 7.
Taking into consideration the nature of allegation, in my view it is fit case to grant the pre-arrest bail. 8.
Accordingly application is allowed subject to following conditions :
ORDER
(i) In the event of the arrest the applicant in the Crime No. I 250 of 2019 the applicant be enlarged on bail, on executing P.R.Bond in the sum of Rs. 30,000/- with one or more sureties in the like amount ;
(ii) The applicant shall furnish particulars of the address and his mobile number alongwith simcard to the Investigating Officer within two days from today ;

(iii) The applicant shall attend the concerned Police Station thrice in a week commencing from 07.11.2019 on Monday, Thursday and Friday between 11:00 a.m. to 2:00 p.m for the period of 60 days or till the charge-sheet is filed;
(iv) The applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case. 9.
